Terms of Service

1. Who we are
gathr is a Shopify app operated by Matthew Bull, trading as the Big Click, a sole trader registered in the United Kingdom. “We”, “us”, and “our” mean the Big Click.
2. Agreement to these terms
By installing the gathr app from the Shopify App Store, you (the “merchant”) agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not install the app.
These terms supplement and do not replace the Shopify Terms of Service or the Shopify API License and Terms of Use, which also apply to your use of the app.
3. The service
gathr lets you sell event tickets through your Shopify store. For products you tag as event tickets, we automatically:
- Generate a unique QR-coded ticket for each item sold.
- Email the ticket to the buyer.
- Provide a mobile scanner and venue portal so you and your staff can check tickets at the door and follow live check-in numbers.
- Report ticket sales back to Shopify so they can be billed under our subscription tiers.
4. Subscription and billing
gathr is offered on monthly subscription tiers, billed through the Shopify Billing API. The current tiers and prices are displayed inside the app on the Plans page.
- Charges are added to your Shopify invoice and collected by Shopify on our behalf.
- Each tier includes a monthly fee (which may be zero) plus a per-ticket usage charge for tickets processed after your free allowance. The first 100 tickets on every plan are free.
- Usage charges are capped per 30-day billing period; the current cap is shown on the Plans page.
- A 14-day free trial applies on first installation. You will not be charged until the trial ends.
- Prices may change with at least 30 days’ notice, communicated by email and inside the app.
5. Cancellation and refunds
You may cancel at any time by uninstalling the app from your Shopify admin. Cancellation takes effect at the end of the current billing period. We do not offer pro-rated refunds for partial months. If a charge is made in error, contact us at info@gathrticket.com and we will work with Shopify to resolve it.
6. Acceptable use
You agree not to use gathr to:
- Sell tickets you are not authorised to sell.
- Engage in fraudulent or deceptive ticket sales (including unauthorised resale or scalping where prohibited).
- Distribute malware, spam, or anything illegal under UK law.
- Reverse engineer, scrape, or attempt to gain unauthorised access to the service.
We may suspend or terminate access if we reasonably believe these terms are being breached.
7. Your events and your customers
gathr is a tool for selling and checking tickets. You, the merchant, remain the seller of every ticket and the organiser of every event. In particular:
- The contract for each ticket sale is between you and your customer. We are not a party to it, and we are not the event organiser, promoter, or box office of record.
- You are responsible for running the event, honouring valid tickets, setting and applying your own refund and cancellation policy, and complying with any laws that apply to ticket sales in your jurisdiction.
- Admission decisions at the door are yours. The scanner reports a ticket’s status; what you do with that information is up to you and your staff.
- Refunds you process in Shopify automatically cancel the associated tickets. It is your responsibility to refund customers when an event is cancelled or changed.
- Ticket buyers with questions about an event or a purchase should contact you, not us.
8. Customer data
You are the data controller for your customers’ personal data; we are the processor. You are responsible for having a lawful basis to sell tickets to your customers and for displaying your own privacy policy on your store. Our handling of customer data is described in our Privacy Policy.
9. Service availability and email delivery
We aim to keep gathr available 24/7 but do not guarantee any specific uptime. The service is provided “as is” and “as available”. Scheduled maintenance and unplanned outages may occur.
Ticket emails are sent through a reputable third-party email provider. We take deliverability seriously, but we cannot guarantee that any particular inbox will accept or display an email. Every ticket also remains accessible at its permanent link, which appears in the buyer’s order confirmation, and can be re-sent from the app.
10. Limitation of liability
To the maximum extent permitted by UK law, our total liability to you for any claim arising out of or in connection with the app is limited to the fees you have paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, special, or consequential losses, including loss of revenue, profits, goodwill, or data, nor for losses arising from admission decisions made at your events.
Nothing in these terms limits our liability for fraud or for anything else that cannot be limited under UK law.
11. Termination
These terms apply for as long as you have gathr installed. They terminate automatically when you uninstall the app. Sections 7, 8, 10, and 14 survive termination.
12. Changes to these terms
We may update these terms from time to time. The “Last updated” date at the top will reflect the most recent change. Material changes will be notified by email and inside the app at least 14 days before they take effect. Continued use after a change constitutes acceptance.
13. Shopify policies prevail
If anything in these terms conflicts with Shopify’s Acceptable Use Policy, Shopify API License, or any other Shopify rule applicable to apps, the Shopify rule prevails.
14. Governing law
These terms are governed by the laws of England and Wales. Any dispute will be brought exclusively in the courts of England and Wales.
